Welcome to Mandelicious™ Bake Studio. By accessing or using our website, placing an order, or interacting with our services, you agree to these Terms and Conditions (“Terms”).

1. Company Information

Mandelicious™ Bake Studio (“Mandelicious,” “we,” “us,” or “our”) operates this website and sells products subject to these Terms. We are based in Boston, Massachusetts, and operate under the laws of the Commonwealth of Massachusetts.

2. Eligibility

You must be at least 18 years old to place an order, or you must be using the site under the supervision of a parent or legal guardian.

3. Product Information

We strive to provide accurate product descriptions, ingredient information, pricing, and availability. However, products may vary due to small batch preparation, seasonal availability, or ingredient substitutions. Photos are for presentation purposes and may not reflect exact packaging or appearance. If you have allergy or dietary questions, contact us before placing an order.

4. Allergen and Cross Contact Disclaimer

Our bake studio is not certified allergen free. Our kitchen processes wheat, dairy, eggs, soy, and nuts. While certain flavors may be offered as gluten free or dairy free upon request, we do not guarantee the complete absence of allergens or cross contact.

If you or your recipient has a severe allergy, you assume all risks associated with ordering and consuming our products and should use discretion before placing an order.

5. Ordering and Payment

By placing an order, you confirm that all information provided is accurate and that you are authorized to use the selected payment method.

We accept major credit cards and the payment options shown at checkout. Payment is due at the time of purchase. Orders are not processed until payment is successfully received.

We reserve the right to refuse, cancel, or limit any order at our discretion, including for suspected fraud, pricing errors, or product availability. If we cancel an order after payment, we will issue a refund to the original payment method.

6. Shipping and Local Delivery

Shipping Locations
We currently ship within the United States. We do not offer international shipping at this time. Please see our Shipping Policy for details.

Order Processing and Shipping Schedule
Orders placed by Sunday at 4:00 PM (ET) are baked fresh and typically ship Tuesday through Thursday to support peak freshness upon arrival. Orders placed after the weekly cutoff will process the following week.

Delivery Timeframes
Most orders arrive within 2 to 4 business days after shipping. Delivery timelines are estimates and may vary due to carrier delays, weather conditions, or peak holiday periods.

Holiday Shipping
During peak holiday seasons, preorder cutoff dates will be shared in advance. We strongly recommend placing orders early, as availability is limited and shipping volumes may affect delivery timing.

Local Delivery
Local delivery is available within a 25 mile radius of our Massachusetts bake studio. Eligible customers will see this option at checkout. Orders must be placed at least 48 hours in advance and are delivered fresh every Friday.

Perishable Products and Carrier Responsibility
Mandelicious products are perishable. Once an order ships, delivery timing and handling are the responsibility of the carrier. We recommend retrieving deliveries promptly upon arrival to ensure freshness.

Address Accuracy
Customers are responsible for providing a complete and accurate shipping address at checkout. Orders shipped to the address provided at checkout are not eligible for a refund or free replacement.

Delivered but Missing
If tracking shows a package as delivered but you cannot locate it, you must contact the carrier first to open a claim. Mandelicious™ Bake Studio is not responsible for theft or loss after a package is marked delivered. Shipping fees are nonrefundable.

7. Returns and Refunds

Because our products are perishable, all sales are final. We do not accept returns or offer refunds.

Order Issues
If your order arrives damaged, incorrect, or compromised during transit, you must contact us within 24 hours of delivery at mandeliciousbakestudio@gmail.com with a photo and brief description. If approved, we may offer a replacement or store credit at our discretion.

We do not issue refunds for carrier delays, weather disruptions, or missed deliveries once an order has shipped. Please review our Returns and Refunds Policy for details.

8. Chargebacks and Payment Disputes

If you have an issue with an order, you agree to contact us first at mandeliciousbakestudio@gmail.com and provide a reasonable opportunity to review and resolve the matter.

You agree not to initiate a chargeback or payment dispute for a valid charge, including for orders that were shipped to the address provided at checkout and show delivery confirmation through carrier tracking, or for issues that were resolved through a replacement or store credit.

If a chargeback or payment dispute is initiated, we may provide the payment processor and or bank with documentation, including order confirmations, customer communications, carrier tracking, delivery confirmation, and product photos, as applicable.

We reserve the right to suspend or refuse future orders associated with accounts, names, email addresses, shipping addresses, or payment methods that have a history of excessive chargebacks or suspected fraudulent disputes.

Nothing in this section limits any rights you may have under applicable law.

9. Privacy Policy

Your privacy matters. We collect personal information necessary to process and fulfill orders. We do not sell your personal information. We may share information with third parties solely as needed to process payments, ship orders, prevent fraud, or comply with legal obligations. Please review our Privacy Policy for details.

10. Intellectual Property

All content on this website, including text, product names, logos, images, designs, and branding elements, is the intellectual property of Mandelicious™ Bake Studio and is protected by applicable laws. You may not copy, reproduce, distribute, publish, or exploit any content without our prior written permission.

Artificial Intelligence, Scraping, and Automated Use
You may not use any automated means, including bots, spiders, scrapers, crawlers, data mining tools, or similar technologies, to access, copy, monitor, or collect content from this website without our prior written permission.

You may not use any content from this website, including product photos, product descriptions, branding, logos, designs, or written copy, to build, train, test, or improve any artificial intelligence system, machine learning model, dataset, or similar technology, without our prior written permission.

Unauthorized use of this website or its content is prohibited and may result in legal action.

11. Reviews, Communications, and User Conduct

We welcome customer feedback and reviews. Nothing in these Terms is intended to prohibit or restrict lawful, honest consumer reviews. However, you agree that you will not use our website, our email channels, or any associated platforms to post or transmit content that is unlawful, threatening, harassing, defamatory, knowingly false, misleading, obscene, or that infringes another party’s rights. We reserve the right to remove or refuse to display content on any webpage we own or control that violates these Terms or applicable law.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website, products, and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

13. Limitation of Liability

To the fullest extent permitted by law, Mandelicious™ Bake Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, your purchase, or your consumption of our products.

This includes, without limitation: allergic reactions or other adverse health outcomes; shipping delays, carrier errors, damage, or loss once shipped; inaccuracies or interruptions relating to website access; and any claims related to dietary suitability or ingredient sensitivity.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mandelicious™ Bake Studio from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the website, or your violation of any law or third party rights.

15. Force Majeure

We are not responsible for any failure or delay in performance due to circumstances beyond our reasonable control, including weather events, natural disasters, labor shortages, pandemics, transportation disruptions, or supply chain interruptions.

16. Notice, Informal Resolution, and Opportunity to Cure

Before initiating any legal claim related to your purchase, our products, or this website, you agree to provide written notice to us at mandeliciousbakestudio@gmail.com describing the issue and the specific relief you are requesting.

You agree to allow us 30 days from receipt of your notice to review and attempt to resolve the matter (the “Cure Period”). You agree to cooperate in good faith by providing reasonable supporting information, such as your order number, photos, and relevant communications.

This section does not prevent either party from seeking immediate injunctive relief for unauthorized use of intellectual property, scraping, or automated access, or for other urgent circumstances where a court order is necessary.

17. Governing Law and Venue

These Terms are governed by Massachusetts law, without regard to conflict of law rules. Any dispute arising from these Terms must be brought in the state or federal courts located in Massachusetts, and you consent to that jurisdiction and venue.

18. Attorneys’ Fees and Costs (Prevailing Party)

To the fullest extent permitted by law, in any action or proceeding arising out of or relating to these Terms, the Prevailing Party will be entitled to recover its reasonable attorneys’ fees and costs.

For purposes of this section, “Prevailing Party” means the party that obtains substantially the relief sought in a final, nonappealable court decision, including a dismissal with prejudice, judgment, or comparable final determination.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Meementandelicious™ Bake Studio regarding your use of the website and purchases.

21. Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the website after changes are posted constitutes acceptance.
